Terms of service

These terms are the agreement between you and Gain.fm. Using the service means you accept them.

What we provide

Gain.fm gives you landing pages that send a fan to Spotify, along with tracking on your own Meta pixel and reporting on what happened. Separately, and only if you ask for it, we will build and run advertising campaigns for you.

Your account

Payment

Your content, and what you promise us

Your music, artwork, and copy stay yours. You give us only the permission needed to host and display them on your pages. You promise that you own or are licensed to use everything you upload, and that your pages will not break the law or infringe anyone else's rights.

You agree not to use Gain.fm to:

Artificial streaming is grounds for immediate termination without refund, because it puts every other artist on the platform at risk.

Results

Any campaign figures shown on our site come from real client accounts and describe those campaigns only. They are not a promise of what your campaign will do. We cannot and do not guarantee any number of streams, followers, tickets, or any particular cost per result.

Things outside our control

We are not affiliated with, endorsed by, or acting on behalf of Spotify, Meta, Instagram, or any other platform. Those companies change their rules, their APIs, and their pricing whenever they like, and any of those changes may affect how Gain.fm works. We will adapt as fast as we can, but we cannot be responsible for their decisions.

Uptime

We work to keep Gain.fm available at all times and it runs on infrastructure built for that. We do not offer a formal uptime guarantee, and the service is provided as is.

Limit of liability

To the extent the law allows, our total liability to you for any claim is limited to what you paid us in the 12 months before the claim arose. We are not liable for lost profits, lost streams, or other indirect losses.

Ending it

You can cancel whenever you like from your account or by emailing contact@gain.fm. We can suspend or close an account that breaks these terms, and where it is reasonable to do so we will warn you first. If we close your account without cause, we refund the unused part of your term.

Governing law

These terms are governed by the laws of the State of California, and any dispute will be handled in the courts of Los Angeles County.

Changes

If we change these terms in a way that materially affects you, we will email you at least 30 days before it takes effect.
